Children of non-Naga fathers, non-Naga kids adopted by Naga parents not entitled to ST status

The Kohima district administration has announced that children of non-Naga fathers, and non-Naga children adopted by Naga parents would not be entitled to Scheduled Tribe, backward tribe, or Indigenous Inhabitant tribe certificate.
The order passed by the Kohima district administration on May 12 in pursuance to the Government of Nagaland order of June 11, 2012 stated, “Children of non-Naga fathers, as well as non-Naga children adopted by Naga parents, etc. are not to be given scheduled tribe, backward tribe, or indigenous inhabitant tribe certificates.”
The district administration has directed all concerned Area Administrative Officers under Kohima district to ensure strict compliance while verifying the authenticity of the applicants before forwarding them to the issuing authority.
“Further, all concerned Area Administrative Officers are directed to issue similar instructions to all the Village Councils and GBs within their respective jurisdictions for strict adherence to the government order,” the order read.
Kohima Deputy Commissioner, Shanavas C, speaking to Northeast Live in regard to the notification issued by Personnel and Administrative Reforms (P&AR), which has been effective since 2012, said, “It’s a very old notification, so we just read and re-edited it to all the officers while forwarding the proposals to our office for signature of ST certificates and indigenous certificates. We just have to be careful that children belong to Naga fathers only. So P& AR has very much clarified that children of non-Naga fathers or adopted children of Naga couples are also not entitled to the certificates.”
Shanavas also said that whenever there is a doubt about the authenticity of any certificate or of any person, it is forwarded to the concerned area administrative officer and the concerned village for verification.
“We make sure that this guideline is followed strictly, and only then we issue the certificate”, he added.
In 2006, the Supreme Court ruled that children born out of a marriage between a tribal woman and a non-tribal forward-class man cannot claim the status of the scheduled tribe and seek employment in the government under the reserved category.
