Udalguri encounter: Assam Police defends action

The Assam Police in this regard has released a press statement.

The Assam Police has defended it’s action regarding the Udalguri encounter case. While there was a confusion if the real perpetrator was gunned down in the encounter, the police said that Kenaram Basumatary, a surrendered NDFB cadre is a prime accused in several armed robbery cases. Meanwhile, according to the police, Dimbeshwar Muchahary alias Gobla is also a know criminal with modus operandi of armed robberies.

The Assam Police in this regard has released a press statement.

As per the press release, the Police said, “On 24/02/2023, based on specific input an ambush was laid at village No.1 Dhansirikhuti Daifang under Rowta PS, District – Udalguri by Udalguri Police to inhibit a planned robbery by veteran criminal Kenaram. At about 10.30 AM, 2 individuals arrived at the spot in a motor bike without a number plate. In pursuit of committing robbery, one of the individuals confronted the police team with a 7.65 mm pistol and fired upon the police team causing grievous injury to 1 police sub-inspector and 1 constable. Having come under continuous fire, in self defence, the police team retaliated and as a result one of the accused sustained bullet injury. When the police rushed to him, a 7.65 mm pistol, 2 rounds 7.65 live ammunition, one bullet head and one empty case was found. The second individual fled the scene in the motor bike.”

The press statement further added,”Immediately, the injured police and the accused were shifted to the nearest hospital but the accused person was declared brought dead. The injured sub inspector was critical and was referred to Guwahati Medical College. There he underwent surgery and a 7.65 mm bullet was surgically extracted from his right hand and seized. In this regard, Rowta P.S. Case No. 61/2023 u/s 398/353/333/326/307 IPC r/w 25(1A)/27 of Arms Act has been registered.”

The police further said,”With regard to the accused person declared dead, the family of Kenaram Basumutary, rushed in, positively identified and claimed the body. The body was handed over with written receipt of the mother of the deceased in presence of two witnesses after inquest and post mortem was conducted by following proper procedure. Kenaram Basumutary, a surrendered NDFB cadre, is a veteran criminal from village Natun Panbari, Orang, Udalguri. He was the prime accused in several armed robbery cases of similar modus operandi including armed dacoity at Nalbari PS (Assam), armed robbery and firing at police team of Roing PS (Arunachal Pradesh) and in armed robbery of petrol pump at Khleriat PS (Meghalaya). He has been arrested in several cases leading to recovery of cash proceeds of crime and arms. His last rites were conducted in village Natun Panbari, Orang on 24.02.2023 late evening by his family.”

Further informing about the incident, the police said,”Subsequently, on the next day, i.e., 25.02.2023, at about 6.30 pm, a family arrived at the Office of Superintendent of Police, Udalguri from Jengrenpara village of Baksa claiming the deceased person to be Dimbeshwar Muchahary. Dimbeshwar Muchahary alias Gobla is also a veteran criminal with modus operandi of armed robberies. He had been arrested in Rangia PS Case no 783/20 u/s 120 (B)/384/387/447 IPC r/w Sec 25(1A) of Arms Act. One pistol and one round 9 mm ammunition was recovered from his house at the time. Further, in SBI CSP looting case, i.e.,Gobardhan PS Case no 150/2021 u/s 120(B)/397 IPC r/w Sec 25(1A) of Arms Act, 2 pistols were recovered from his arrested gang members. An absconder chargesheet had been filed against Dimbeshwar Muchahary at the time. In the same chargesheet of Gobardhan PS, Kenaram Basumutary has also been shown as absconder and as a member of the same gang.”

“The family of Dimbeshwar Muchahary has written for exhumation of the body under Magistrate. We have forwarded the written request and with the receipt of a positive magisterial order, the exhumation may be conducted. Following this on receipt of a Court order, DNA profiling may be done to verify the claim regarding the identity of the deceased,” the police press statement added.
