APPSC Fiasco: Accused Opet Mibang granted default bail

Another accused in the alleged Arunachal Pradesh Public Service Commission (APPSC) question paper leak case, Opet Mibang has been granted default bail by the Guwahati High Court, Itanagar bench yesterday (January 31, 2023) as the Central Bureau of Investigation (CBI) has failed to file a charge sheet against her within the statutory period of 90 days.

It is to be mentioned that if the investigating agency fails to complete the investigation and submit a charge sheet to a court of competent jurisdiction within the predetermined time frame of either 60 or 90 days, Section 167 of the Code of Criminal Procedure Code allows for the issue of default bail to the accused.

As per reports, Opet Mibang had appealed for a default bail petition, claiming that her involvement in the paper leak case was minimal and that she had already completed the period of 90 days.

Mibang is the wife of accused Anam Jerang, who was granted bail by the District and Sessions Court, Yupia on January 30, 2023 on grounds that CBI failed to file chargesheet within the statutory period of 90 days. The Court, as such, granted him bail with surety amount of Rs 30,000.

Opet mibang who was serving as Upper Divisional Clerk (UDC) in Yingkiong, Upper Siang district and her husband Anam Jerang were arrested by the Special Investigation Cell (SIC) of the Arunachal Pradesh police in connection with the paper leak case on October, 2022.

It may be mentioned that the AE (civil) question paper leak case has been handed over to the CBI.

The SIC is investigating all the other cases based on several FIRs filed by the aggrieved aspirants.

The SIC is investigating cases since 2014 related to the paper leak case.
