Arunachal: Guwahati High Court quashes detention order against Techi Puru and Tadak Nalo under APUAPA

While highlighting the significance of preventative detention cases, the court deemed the detention orders as stale and said that they require intervention

The writ petition filed by Pan Arunachal Joint Steering Committee (PAJSC) chairman Techi Puru and vice chairman Tadak Nalo which challenged the detention order under Arunachal Pradesh Unlawful Activities (Prevention) Act (APUAPA) against them was quashed by Itanagar bench of the Guwahati High Court.

The petitioners had claimed that they were not involved in the 3-day bandh call in Itanagar Capital region in May given by a few individuals leading to the passing of the detention orders.

While highlighting the significance of preventative detention cases, the court deemed the detention orders as stale and said that they require intervention.

Consequently, the court has quashed the impugned orders that were issued on May 10, 2023.

Additionally, the order for their proclamation under Section 82 of the Code of Criminal Procedure in connection with Section 7(1)(a) APUAPA has been revoked in the absence of proof suggesting the factum of absconding and evading arrest by the petitioners.

Since the Court found sufficient merit in their petitions and granted them relief for Techi Puru and Tadak Nalo’s it was a victory for them.
