Congress MPs withdraw plea challenging rejection of notice to impeach CJI Dipak Misra

Just a day after going to the Supreme Court, the Congress today withdrew its petition on the impeachment move against Chief Justice of India Dipak Misra which was rejected recently by Vice President Venkaiah Naidu.

The petitioners who are two Congress lawmakers Partap Singh Bajwa and Amee Harshadyay Yajnik questioned the decision to assign the case to a five-judge constitution bench of the Supreme Court.

Representing them, senior Congress leader and lawyer Kapil Sibal said the case was listed before the constitution bench through an administrative order and the Chief Justice “can’t pass such orders”.

He said he was withdrawing the petition after the Constitution bench refused to give the petitioner details of the administrative order passed in constituting the bench.

The Congress petition filed yesterday had said Venkaiah Naidu’s decision to reject the opposition’s impeachment notice was “illegal and arbitrary” and taken in a “cavalier, cryptic and abrupt manner”.

Earlier on the 23rd of April, Rajya Sabha Chairman M Venkaiah Naidu rejected the notice given by the 7 opposition parties led by the Congress for impeachment of CJI Dipak Misra citing lack of substantial merit in it.
