Naga Club admits to demolishing NSF central office; court gives 3 days time to Naga Club members to surrender

The reason behind the demolition of the central office of the Naga Students Federation has come to light after the Nagaland Club admitted that it has brought down the NSF office despite “notices were served” to the apex Naga students body.

As per inputs, the Naga Club confessed on Sunday that it entrusted youths to demolish the structure of the Naga Club building in the early hours of Saturday. It further explained that its members were not miscreants, but ‘bonafide owner of the land and building’ and therefore ‘the question of vandalizing public property or criminal trespass by unknown miscreants as alleged by the NSF does not arise.’ Rather, Naga Club said that it was the Naga Students’ Federation that was unlawfully and forcefully occupying the Naga Club Building.

Subsequent to this, the Nagaland Club filed a petition before the court praying for quashing of the FIR filed by the NSF against the demolition of its central office.

The club declared that the FIR filed by NSF was ‘malicious, baseless, misconceived and misleading’ and that the present issue between the club and the federation is a civil issue and should be tried and decided by a Civil Court.

Notably, the Kohima Bench of the Gauhati High Court has granted 3 days time to 6 Naga Club members to ‘surrender’ who had prayed for anticipatory bail consequent to theFIR filed by the NSF.

The court directed that if the petitioners surrender within the time stipulated, in the event of the arrest in connection with the said case, the arresting authority shall allow the petitioners to go on bail of Rs 20,000 with one surety of like amount during the period, till the next hearing of the case, to the satisfaction of the arresting authority.

While giving the ruling regarding the anticipatory bail of the 6 Naga Club leaders, the court also mentioned about the petition submitted by the Nagaland Club which stated,”the NSF was invited on several occasion by the Nagaland Club for a discussion regarding the Naga Club building. However, the NSF did not attend those meetings and ultimately eviction notices were issued to the NSF by the NC.

However, inspite of that the NSF did not come forward for a discussion, ultimately the Naga Club decided to demolish the said building for the purpose of construction of a new building at the spot and in this regard Naga Club also obtained necessary building permission from Kohima Municipal Board.”

The next date of hearing has been fixed for June 5.
