The Supreme Court has stayed proceedings against 30 troopers of the 21 Para Special Force in connection with the Oting shootout in Nagaland that led to the death of 14 civilians last December.
The SC bench headed by Justice Indira Banerjee and V Ramasubramanian also observed that the death of a paratrooper during the incident has not been investigated yet.
It may be mentioned that the 21 Para SF troopers were booked by the Nagaland Police in connection with the quote unquote ‘bothched ecounter’.
The big decision by the Supreme Court comes in response to a plea filed by a kin of a Major, who was booked by the Nagaland police.
The petitioner sought quashing of the concerned first information report (FIR), the findings and recommendations of the Special Investigation Team appointed by the Nagaland government, and all other ancillary proceedings arising out of the December incident including the complaint filed by the National Human Rights Commission.
As per sources, the petitioners prayed before the court that the SIT of Nagaland police and State functionaries had allegedly ‘turned a blind eye’ to the safety of the accused and their family members by revealing their personal information.
Moreover, the fact that despite being protected by the Armed Forces Special Powers Act and the Army Act, the Para troopers are being proceeded against under the Criminal Procedure Code instead, was argued.
