Abdur Rashid was declared a foreign national by the Foreigners' Tribunal in 2016 while, Mohammad Khairul was declared a foreign illegal foreigner in 2015.
In a major development, two Bangladeshi nationals working as teachers at different schools in Assam’s Morigaon have been terminated from their positions.
The individual in question have been identified as Abdur Rashid Sc. Teacher of Ulubari MEM under BEEO, Laharighat and Khairul Islam, Assistant Teacher of Thengkhali Khandapukhuri LP School, under BEEO, Kapili in Morigaon district.
Abdur Rashid was declared a foreign national by the Foreigners’ Tribunal in 2016 while, Mohammad Khairul Islam was declared a foreign illegal foreigner in 2015.
Challenging this verdict of the Foreigners Tribunal, both Abdur Rashid and Khairul Islam filed writ petitions in the Gauhati High Court. But the Gauhati High Court in 2018 dismissed the writ petitions refusing to interfere with the earlier verdict of the Foreigners Tribunal.
The Gauhati High Court then sent the duo to a detention camp. During their time in detention, Rashid and Khairul were suspended from their job by the District Elementary Education Officer (DEEO) of Morigaon.
Later, Khairul Islam was released from the detention camp in 2020 and Abdur Rashid was released in 2021.
In pursuance thereof, an Inquiry Committee was formed to determine whether Abdur Rashid and Khairul Islam who had been declared foreigners, could continue serving as a government employee.
Later, the Senior Standing Counsel, Department of Elementary Education, Government of Assam upheld the judgement of the Gauhati High Court that they have no right to hold a public office in India.
The legal opinion suggested that the duo be terminated from their government services, following the appropriate legal procedures.
Based on this, the report from the Inquiry Committee in February, the duo were terminated from their positions on December 24, 2024.
Meanwhile, Khairul Islam still claimed to be an Indian.
