Meghalaya Govt approves enforcement of Bharatiya Nagarik Suraksha Sanhita (BNSS) from July 1

MDA Goverment spokesperson and Social Welfare Minister Paul Lyngdoh said that the cabinet also approved the guidelines for compulsory crime scene investigation by forensic teams

The Meghalaya cabinet on Wednesday approved the enforcement of the new criminal law Bharatiya Nagarik Suraksha Sanhita (BNSS) from July 1.

MDA Goverment spokesperson and Social Welfare Minister Paul Lyngdoh said the central government has notified the BNSS in which states need to transit from the old Code of Criminal Procedure (CrPC) to the new BNSS by July 1 this year.

Briefing newspersons, Paul Lyngdoh said, “The issue here is that Government of India has notified that by July 1, the BNSS shall come into force and shall replace the CrPC. Hence the need is that we by July 1 switch over to implementing the BNSS. Since these criminal laws are coming into force with effect from July 1, the state government is supposed to notify the application of the BNSS 2023 to facilitate adjudication of criminal justice. So this matter was considered by the cabinet and it was cleared since we were supposed to transit into the new arrangement and replace the CrPC.”

Lyngdoh said that the cabinet also approved the guidelines for compulsory crime scene investigation by forensic teams. The MDA government spokesperson further said, the forensic experts would be stationed in all the district headquarters of the state.

“Again this linked to the new arrangement that is the BNSS, whereby it has become mandatory for the state to ensure that forensic experts visit crime scenes. There are certain categories of crime which are of heinous nature where the punishment is 7 years of imprisonment and above. Now the state government through the Directorate of Forensic Sciences had submitted a proposal seeking the approval of the cabinet to notify the guidelines for compulsory forensic crime scene investigation. The cabinet has considered and approved this proposal. Under this new proposal we will have forensic teams stationed in all district headquarters,” Lyngdoh added.
